📜 PETITION TO THE HAWAI‘I STATE LEGISLATURE

Demand Equal Rights for Condo & HOA Owners—Establish a State Office for HOA Oversight

To the Honorable Members of the Hawai‘i State Legislature:

We, the undersigned residents and property owners of condominium and homeowner associations (AOAOs) across the state, respectfully petition for legislative reform to ensure equal protection under the law for individual owners and residents—rights currently eclipsed by the disproportionate power and protections afforded to associations and the management companies they employ.

THE PROBLEM

In today’s governance structure, the term “association” is too often synonymous with management companies—not the people who actually live in or own the property. These corporations exert outsized influence on legislative policy, board operations, and enforcement practices, leading to a system that favors:

  • Excessive fees and arbitrary fines
  • Lack of transparency and access to records
  • Rigged elections and board mismanagement
  • Unchecked retaliation against dissenting owners
  • Inaction or complicity in cases of embezzlement or abuse

As it stands, owners must bear the full financial and emotional burden of taking civil action when their rights are violated, while boards and management companies use association funds to defend their own misconduct.

THE SOLUTION

We demand the establishment of a State Office for HOA & AOAO Oversight, which would:

  • Serve as a low-cost, administrative pathway for resolving owner complaints
  • Review claims of legal violations, procedural misconduct, or financial abuse
  • Send formal Notices of Violation to boards, managing agents, or related professionals upon credible evidence
  • Maintain a record of repeat offenders for regulatory or licensing action
  • Offer education and transparency tools for owners and board members alike

This office must be empowered to act independently of the real estate and management lobby, and to enforce compliance with HRS §514B, the Hawaii Nonprofit Corporations Act, ADA requirements, and other relevant statutes.

WHAT WE ASK

We call upon the Hawai‘i State Legislature to:

  1. Codify equal rights and enforcement protections for owners in all community association statutes
  2. Create and fund a State Office for HOA & AOAO Oversight under DCCA or a dedicated regulatory agency
  3. Ensure this office has the authority to investigate claims, issue violation notices, and recommend penalties where needed
  4. Protect homeowners and residents from retaliation when seeking relief or reporting misconduct
